These Terms of Service ("Terms") govern your access to and use of www.trymielle.com (the "Site") and all purchases made through it. By accessing the Site or placing an order, you agree to be bound by these Terms without limitation or qualification. If you do not agree, do not use the Site.

2. Eligibility
You must be at least 18 years old, or the age of majority in your state of residence, and able to form a legally binding contract to purchase from the Site. By placing an order, you represent that you meet these requirements and that all information you provide is accurate.
3. Products
Products are described and presented as accurately as possible. Images are for illustrative purposes only and actual products may vary. All products are subject to availability, and we reserve the right to modify or discontinue any product at any time without notice.
4. Product Safety & Intended Use
Mielle products are personal care devices intended for cosmetic use only. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
- Do not use on broken, irritated, inflamed, or infected skin, or on open wounds.
- If you have diabetes, poor blood circulation, or any medical condition affecting your feet or skin, consult a healthcare professional before use.
- Discontinue use immediately if you experience pain, excessive redness, or irritation.
- Read and follow all instructions provided with the product before first use. Keep out of reach of children.
Failure to follow usage instructions and safety warnings may result in injury for which we are not responsible to the extent permitted by law.
5. Orders & Acceptance
By placing an order, you agree to the prices, product descriptions, and Terms in effect at the time of purchase. Your order is an offer to buy; a contract is formed only when we accept and dispatch your order. We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, unauthorized transactions, resale, or errors in pricing or product information. If we cancel an order after payment, we will issue a full refund.
6. Prices & Payment
All prices are displayed in U.S. dollars (USD), exclusive of applicable sales taxes. Any applicable sales tax is calculated and displayed at checkout based on your delivery address. Accepted payment methods include credit card, Apple Pay, Google Pay, and PayPal. Payments are processed securely by our third-party payment providers; we do not store full card details. We reserve the right to change displayed prices at any time and to correct pricing errors; if a pricing error affects an order you have already placed, we will contact you with the option to confirm at the correct price or cancel for a full refund.
7. Shipping & Delivery
We currently ship to addresses within the United States only. Orders are typically processed within 24-48 business hours after payment confirmation. Estimated delivery times are 5-10 business days after dispatch. If we are unable to ship within the time stated (or within 30 days where no time is stated), we will notify you and offer the option to consent to a delay or to cancel for a full refund, consistent with the FTC Mail, Internet, or Telephone Order Merchandise Rule. We are not responsible for delays caused by carriers, weather, or any event beyond our reasonable control. Standard shipping is free. An optional express delivery method is available for the fee displayed at checkout before you complete your purchase. Risk of loss passes to you upon delivery to the carrier. If your tracking shows your package as delivered but you cannot locate it, or if your package appears lost in transit, contact us at contact@trymielle.com within 14 days. To help us resolve the issue quickly, we may ask you to confirm your shipping address, check with household members and neighbors, and contact the carrier with your tracking number to report the non-delivery and provide us with any case or reference number issued. We will then open a formal investigation with the carrier and, where non-delivery is confirmed, offer a replacement or a refund.

Purchases are subject to our Refund & Return Policy, which is incorporated into these Terms by reference. Please review it before ordering.
9. Intellectual Property
All content on the Site — including logos, trademarks, text, graphics, images, and product designs — is owned by or licensed to us and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, or use any content without our prior written permission.
10. Acceptable Use
You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to submit false information, or to engage in fraudulent transactions. We may suspend or terminate access for any violation.
11. Disclaimer of Warranties
Except as expressly stated in our Refund & Return Policy and to the fullest extent permitted by law, the Site and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow the exclusion of certain implied warranties, so some of the above may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, we and our owners, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or any product. Our total aggregate liability for any claim will not exceed the amount you actually paid for the product giving rise to the claim. Some states do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Mamoru Group LLC and its owners, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site or products.
14. Dispute Resolution — Binding Arbitration & Class Action Waiver
Please read this section carefully; it affects your legal rights.
Informal resolution first: Before filing any claim, you agree to contact us at contact@trymielle.com and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration: If the dispute is not resolved, any dispute arising out of or relating to these Terms or your purchase will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring a qualifying claim in small-claims court.
Class action waiver: You and we agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Opt-out: You may opt out of this arbitration agreement by sending written notice to contact@trymielle.com within 30 days of your first purchase. If you opt out, or for any claim not subject to arbitration, the courts described in the following section will have jurisdiction.
15. Governing Law & Venue
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules. Subject to the arbitration section above, any dispute not resolved by arbitration shall be brought exclusively in the state or federal courts located in New Mexico, and you consent to their jurisdiction.
16. Changes to These Terms
We may update these Terms at any time. The updated version will be posted on this page with a new "Last updated" date and takes effect when posted. Your continued use of the Site constitutes acceptance of the revised Terms.
17. Electronic Communications
By using the Site, you consent to receive communications from us electronically (email or on-site notices), and you agree that electronic agreements and notices satisfy any legal requirement that such communications be in writing.
18. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely. These Terms, together with the Refund & Return Policy and Privacy Policy, constitute the entire agreement between you and us. We are not liable for any failure to perform due to events beyond our reasonable control (force majeure).
